بيان من مجمع
فقهاء الشريعة بأمريكا
حول إمامة المرأة لصلاة
الجمعة وإلقائها لخطبتها
الحمد لله والصلاة
والسلام على رسول الله
أما بعد فقد ورد
إلى مجمع فقهاء الشريعة
بأمريكا استفسار حول
مدى مشروعية إمامة المراة
لصلاة الجمعة وإلقائها
لخطبتها وذلك بمناسبة
ما أعلن عنه مؤخرا من اعتزام
بعض النساء على إلقاء
خطبة الجمعة وإمامة صلاتها
بأحد مساجد نيويورك
والمجمع
إذ يستنكر هذا الموقف
ألبدعي الضال ويستبشعه
فإنه يقرر للأمة الحقائق
التالية:
· أولا:
أن الحجة القاطعة والحكم
الأعلى هو الكتاب والسنة،
وقد قال صلى الله عليه
وسلم ( تركت فيكم ما إن تمسكتم
به لن تضلوا بعدي
أبدا كتاب الله وسنتي
) وأن الإجماع على فهم نص
من النصوص حجة دامغة تقطع
الشغب في دلالته، فقد
عصم الله مجموع هذه الأمة
من أن تجمع على ضلالة،
وأن من عدل عن ما أجمع عيه
المسلمون عبر القرون
كان مفتتحا ! لباب ضلالة،
متبعا لغير سبيل المؤمنين،
وقد قال تعالى (
ومن يشاقق الرسول من بعد
ما تبين له الهدى ويتبع
غير سبيل المؤمنين نوله
ما تولى ونصله جهنم وساءت
مصيرا ) ( النساء:
115 )وقال صلى الله عليه وسلم
في معرض بيانه للفرقة
الناجية في زحام الفرق
الهالكة ( من كان على مثل
ما أنا عليه وأصحابي )
· ثانيا:
لقد انعقد إجماع الأمة
في المشارق والمغارب
على أنه لا مدخل للنساء
في خطبة الجمعة ولا في
إمامة صلاتها، وأن من
شارك في ذلك فصلاته باطلة
إماما كان أو مأموما،
فلم يسطر في كتاب من كتب
المسلمين على مدى هذه
القرون المتعاقبة من
تاريخ الإسلام فيما نعلم
قول فقيه واحد: سني أو شيعي،
حنفي أو مالكي أو شافعي
أو حنبلي يجيز للمرأة
خطبة الجمعة أو إمامة
صلاتها، فهو قول محدث
من جميع الوجوه ، باطل
في جميع المذاهب المتبوعة،
السنية والبدعية على
حد سواء!
·
ثالثا: لقد علم بالضرورة
من دين الإسلام أن سنة
النساء في الصلاة التأخير
عن الرجال، فخير صفوف
الرجال أولها وخير صفوف
النساء آخرها، فقد أخرج مسلم في صحيحة
عن أبي هريرة رضي الله
عنه قال: قال رسول الله
:
((خير صفوف الرجال أولها
وشرها آخرها، وخير صفوف
النساء آخرها وشرها أولها))
وما ذلك إلا صيانة لهن
من الفتنة وقطعا لذريعة
الافتنان بهن من جميع
الوجوه، فكيف يجوز لهن
صعود المنابر والتقدم
لإمامة الرجال في المحافل
العامة؟!
· رابعا:
لم يثبت أن امرأة واحدة
عبر التاريخ الإسلامي
قد أقدمت على هذا الفعل
أو طالبت به على
مدى هذه العصور المتعاقبة
من عمر الإسلام، لا في
عصر النبوة ولا في عصر
الخلفاء الراشدين ولا
في عصر التابعين، ولا
فيما تلا ذلك من العصور،
وإن ذلك ليؤكد تأكيدا
قاطعا على ضلال هذا المسلك
وبدعية من دعا إليه أو
أعان عليه.
ولو
كان شيئا من ذلك جائزا
لكان أولى الناس به أمهات
المؤمنين وقد كان منهن
الفقيهات النابغات، وعن
بعضهن نقل كثير من الدين،
وحسبك بالفصيحة البليغة
العالمة النابهة الصديقة
بنت الصديق أم المؤمنين
عائشة رضي الله عنها،
ولو كان في ذلك خير لسبقونا
إليه وسنوا لنا سنة الإقتداء
به، لقد عرف تاريخ الإسلام
فقيهات نابغات ومحدثات
ثقات أعلام، وقد أبلى
النساء في ذلك بلاء حسنا
وعرفن بالصدق والأمانة
حتى قال الحافظ الذهبي
: ( لم يؤثر عن امرأة أنها
كذبت في الحديث) ويقول
رحمه الله : ( وما علمت من
النساء من اتهمت ولا من
تركوها ) ( ميزان الاعتدال
: 4 / 604 ) وحتى كان من شيوخ الحافظ
بن عساكر بضع وثمانون
من النساء! ومثله الإمام
أبو مسلم الفراهيدي المحدث
الذي كتب عن سبعين
امرأة، ومن النساء في
تاريخ هذه الأمة من كن
شيوخا لمثل الشافعي والبخاري
وابن خلكان وابن حيان
وغيرهم!! ومع ذلك
لم يؤثر عن واحدة منهن
أنها تطلعت إلى خطبة الجمعة
أو تشوفت إلى إمامة الصلاة
فيها مع ما تفوقن فيه على
كثير من الرجال يومئذ
من الفقه في ا! لدين والرواية
عن النبي صلى الله عليه
وسلم .
لقد
عرف تاريخ الإسلام المرأة
عاملة على جميع الأصعدة،
عرفها عالمة وفقيهة،
وعرفها مشاركة في العبادات
الجماعية، ومشاركة
في العمليات الإغاثية،
ومشاركة في الأمر بالمعروف
والنهي عن المنكر، ولكنه
لم يعرفها خطيبة جمعة
ولا إمامة جماعة عامة
من الرجال.
وبهذا يعلم بالضرورة
والبداهة من دين المسلمين
أن الذكورة شرط في خطبة
الجمعة وإمامة صلوات
الجماعة العامة، وأمام
من يجادل في ذلك عمر نوح
لكي يفتش في كتب التراث
ليخرج لنا شيئا من ذلك،
وهيهات هيهات! وما ينبغي
لهم وما يستطيعون!
· خامسا:
أما تعويل من زعم ذلك على
ما روي من أن أم ورقة قد
أذن لها النبي صلى الله
عليه وسلم في إمامة أهل
بيتها فإن هذا الحديث
على فرض صحته لا علاقة
له بموضوع النازلة، فإنه
يتحدث عن إمامة خاصة داخل
البيت بالنساء أو بهن
وببعض أهل البيت من الرجال
على أوسع التفسيرات وأكثرها
ترخصا فأين ذلك من خطبة
الجمعة والإمامة العامة
للصلاة؟؟
إن المجمع ليحذر
الأمة من الافتتان بمثل
هذه الدعوات الضالة المارقة
من الدين، والمتبعة لغير
سبيل المؤمنين، ويدعوهم
إلى الاعتصام بالكتاب
والسنة، ويذكرهم بان
هذا العلم دين وأن عليهم
أن ينظروا عمن يأخذون
دينهم، وأن القابض على
دينه في هذه الأزمنة كالقابض
على الجمر، ويسأل الله
لهذه الأمة السلامة من
الفتن والعافية من جميع
المحن، وأن يحملها في
أحمد الأمور عنده وأجملها
عاقبة، إنه ولي ذلك والقادر
عليه
والله من وراء القصد
وهو الهادي إلى سواء السبيل

In the name
of ALLAH most Merciful, most Beneficent
A Statement
from the AMJA about the issue of women leading the Friday prayer and delivering the ceremony
All praise is due to ALLAH and may the peace and the blessing of ALLAH
be upon our Prophet Mohamed.
A question was raised to AMJA about the permissibility of a woman leading
the Friday prayer and delivering the ceremony. The question was raised as it was announced the in a Masjid in the New York area that a woman plans to lead
the Friday prayer and deliver the Khutbah.
AMJA totally denounce such action, which is a complete heresy, and affirms
these facts:
- The ultimate reference
and the supreme source of legislation of Islam is the book of ALLAH (SWT) and the purified sunnah of the Prophet (PBUH). The
Prophet said :” I left amongst you that which if you hold on to it you will never go astray after me: the book of
ALLAH (SWT) and my Sunnah”. Consensus and unanimity on the interpretation of a certain text in these two sources
is an irrefutable proof for its meaning and a clear unambiguous sign and evidence that any other later interpretation is nullified,
void and rejected. ALLAH (SWT) has said in Surat Al-Nisaa what can be translated as: “If anyone contends with the
Messenger even after guidance has been plainly conveyed to him, and follows a path other than that becoming to men of Faith,
We shall leave him in the path he has chosen, and land him in Hell, what an evil refuge” And the Prophet (PBUH)
described the successful group among the ones that went astray as being “who follow and behave as what I and my companions
follow and behave”
- Secondly: A unanimous
consensus for the entire Ummah, in the east and west that women can not lead the Friday prayer nor can they deliver the ceremony.
Whoever takes part in such a prayer, then his prayer is nullified, whether he was and Imam or a follower. It is never found
in any jurisprudential text, from Sunnah Scholars (Hanafi, Maliki, Shafii nor Hanbali) or even from Shiite scholars, that
a woman can lead the Friday prayer nor deliver the ceremony. This opinion is an innovation and a heresy on any account, nullified
by all scholars.
- Some of the evidence
that led to the above mentioned consensus is what came in the purified sunnah that the rows of the women should be behind
the rows of the men in the prayer. In the Hadeeth narrated by Anas (Bukhari) said “ the Prophet (PBUH) prayed as
Imam for Anas, his mother and his Aunt, he made Anas stand on his right side and Anas’s mother and his aunt behind them”.
Same arrangement was followed in the Masjid of the Prophet (PBUH) and across the entire Ummah for centuries. Imam Muslim narrated
that the Prophet (PBUH) said that ”The best rows for the men are the front ones and the least good are the ones towards
the back, and the best rows for the women are the ones towards the back the least good are the ones towards the front”
This was for no other reason but to protect them from any embarrassment and to close the door on any evil thoughts or temptations
that might come into the hearts of whomever might be looking at them otherwise.
How could it be possible then that a woman can be in front of all rows leading the Friday prayer?!
- Another evidence
is that is well established in Islamic jurisprudence that ALLAH (SWT) has not made prayer in congregation mandatory for women,
neither is it obligatory that women pray Friday prayers. The Prophet (PBUH) mentioned in the authentic narration through Abu
Dawood: ”Friday prayer is mandatory upon each Muslim (to be performed) in a congregation, the only types of people
who are exempt: a slave, a woman, a young boy or a sick person (i.e. it is not mandatory for these people to attend the congregation)”
In addition, the Prophet (PBUH) informed Muslim women that their prayer at home better for them than attending the congregation,
out of mercy upon them that they face the hassles of going out and to shield them from temptations. The Prophet (PBUH) said
“ Do not prevent the women from going to the Masjid, whoever, it is better for them to pray at home” [narrated
by Imam Ahmed and Abu Dawood]. How could it be possible then that it is not mandatory for a woman to pray in the Masjid, to
achieve the intent of the legislator (ALLAT (SWT)) of making it easy upon women by praying at home, while shielding them from
temptations, then a woman goes up on the pulpit to deliver the ceremony, and stand in front of the rows as Imam!!
- It was never recorded that a single woman, across Islamic history, has performed such an action, nor even
demanded to do it. Not in the time of the Prophet (PBUH), nor in the time of the companions, or their followers, not even
in later generations and centuries. This is by itself constitutes a clear proof on the invalidity of this opinion, and that
anyone who calls for it or help to implement it is a heretic.
If any of this has a shade or legitimacy, the most qualified women to actually
do it were the mothers of the believers; most of them were knowledgeable brilliant scholars. It is enough to talk about the
eloquent, articulate, bright and knowledgeable Ai’sha, daughter of Abu Bakr, wife of the Prophet (PBUH), mother of the
believers. If there was any shred of evidence that this action is good and permissible, these shining examples among Muslim
women would have taken the lead to it. There were numerous women scholars across Islamic history, jurisprudential references
and narration experts; they were honest, trustworthy and expert in what they accomplished. Imam Hafiz Zahabi said: “It
was never recorded that a woman propagated false Hadeeth attributed to the Prophet (PBUH)”, he also mentioned that “I
am not aware of any woman that were accused of propagating falsehoods or ones that their narrations disregarded”. Among
the teacher of Imam Hafiz bin Asaker were eighty something women. Similarly for Imam Abu Muslim al-Farahidi, who reported
the narration of seventy women. Imam Shafii, Bukhari, Ibn Khalakn and Ibn Haian all had women among their teachers. None of
these noble women scholars ever attempted to lead the Friday prayer nor deliver the ceremony, even that they were superior
in knowledge over many of their contemporary men in Jurisprudence, Religious knowledge and narrations from the Prophet (PBUH).
Muslim women participated in all aspects of Islamic work throughout Islamic
history: as a scholar and jurisprudential reference, as participating in all kinds of worship, as workers in the field of
relief and emergency aid and in the enjoining of good and forbidding of evil. But never were they Imams for Friday prayers
or have ever delivered Friday ceremonies.
It is a logical, fundamental conclusion that only men are allowed to perform
such a function as leading the Friday prayer and delivering the ceremony. Whoever disputes this fact can take as much time
as he wants to dig out one single example form the volumes of Islamic Jurisprudence across the centuries, and they will miserably
fail.
- Lastly: Those who
are calling for such acts, are taking as an excuse a narration that Um Waraqah was given the permission by the Prophet (PBUH)
to lead her household members in the prayer. This narration, even assuming that it is authentic, has nothing to do whatsoever
with the Friday prayer. It is talking about some very specific circumstances where a woman can lead the prayer inside her
home, and has no relation to Friday prayer and general congregations.
AMJA is delivery this somber warning message to the entire Ummah, not to
give any credit to such false initiatives that contradicts with the basics and fundamentals of the religion, and is a totally
heretic innovation. AMAJ reminds Mulsims that we are to follow only the book of ALLAH and the purified Sunnah of the Prophet
(PBUH). Muslims should pay careful attention to whom they are seeking the guidance from, indeed he who strives to cling on
to his religion nowadays is suffering as much as a person who is trying to keep a tight fist on a piece of flaming charcoal
in the palm of his hand. AMAJ is extending a sincere supplication to non but ALLAH (SWT) to save us from all trials and tribulations,
and to guide us all to that which is closest to the mercy and pleasure of ALALH (SWT), as he is the only one capable of that.
It is ALLAH (SWT) alone that we seek in all of our actions, and it is he
alone that can guide to the straight path.
